Car Rental Agreement
Article 1: The parties to the contract: the Lessor (hereinafter referred to as "Party A") and the Lessee (hereinafter referred to as "Party B") hereby agree to enter into this contract for the rental of the vehicle (hereinafter referred to as "the Vehicle").
Article 2: Details of the Vehicle, on-board equipment, pre-rental condition photos, initial mileage, rental period, rental calculation, and payment method are as stated in this contract. Upon signing this contract, Party B acknowledges receipt and acceptance of the Vehicle. However, ownership of the Vehicle and its accessories remains with Party A. This contract only entitles Party B to use the Vehicle and its accessories for the agreed period; Party B does not acquire any other rights. During the rental period, Party B is not an agent of Party A for any purpose. Any repair or replacement of the Vehicle’s parts or accessories must be approved in advance by Party A. Party B shall pay all rents and related fees to Party A in accordance with this contract. If there are two or more Lessees, they shall be jointly and severally liable for payment. Party B must present a valid driver’s license and national ID card when renting the car; Party A will make copies for records after verification.
Article 3: Party B shall return the Vehicle on time. Except for force majeure, a late fee will be charged for returns delayed by 60 minutes or more (and so on). A full-day rental fee will be charged for delays exceeding 6 hours. For delays exceeding 12 hours, in addition to the full-day rental fee, a 50% temporary vehicle dispatch fee will be charged (this fee compensates Party A for the full-day rental loss and covers temporary dispatch costs caused by the delay, which prevents the next customer from picking up the car on time).
Article 4: During the rental period, Party B must carry the driver’s license, Compulsory Vehicle Liability Insurance Certificate, car rental slip, and vehicle registration certificate for inspection. Parking fees, tolls, and other related expenses incurred during the period shall be borne by Party B. Party B shall be responsible for paying fines for traffic violations; if Party A pays on behalf of Party B, Party B shall reimburse Party A. If Party B violates Article 35 of the Road Traffic Management Penalty Act and the rented vehicle is impounded in accordance with Article 85-2 of the same Act, Party B agrees to authorize Party A to handle installment payment of fines to retrieve the vehicle. Party B shall bear the rent from the date the license plate is seized until the date the Motor Vehicles Office notifies that it can be retrieved.
Article 5: The passenger car shall not be used in the following circumstances: (1) Carrying passengers or goods for explicit or implicit remuneration; (2) Pushing or towing any vehicle or object; (3) For racing or other experimental purposes; (4) For any purpose that violates the laws of the Republic of China or other illegal activities; (5) Driving under the influence of alcohol, narcotics, or hallucinogens; (6) Allowing or instructing anyone without a valid driver’s license to use the vehicle; (7) Obtaining the vehicle from Party A through fraud or misrepresentation; (8) Overloading is strictly prohibited.
Article 6: Party B shall use fuel that complies with the rented vehicle’s specifications. If improper use or low-quality fuel causes abnormal vehicle conditions or malfunctions, Party B shall fully compensate Party A for vehicle repair costs and business losses. Upon return, the fuel level must match the level at pickup; no refund will be given for remaining fuel. Party B shall use the vehicle legally: overloading, carrying contraband, dangerous goods, or items that may stain the vehicle are prohibited. Pets may only be transported in special pet crates. Smoking in the vehicle is prohibited. The rented vehicle shall not be used for commercial purposes or as an ambulance, nor shall its registration information be altered or the vehicle be transferred to a third party. If Party B violates these provisions, Party A has the right to terminate the contract and claim compensation for damages caused by improper use. If the damage is severe, Party A may require Party B to purchase the vehicle at market price.
Article 7: In case of vehicle collision or damage, Party B shall immediately report to the police and notify Party A for original factory maintenance assessment. Regardless of liability for the accident, Party B agrees to first pay for towing fees, repair costs, business losses during maintenance, and vehicle depreciation fees incurred from the accident. These costs shall be fully borne by Party B. Vehicle depreciation fees shall be calculated as 20% of the repair costs. If Party B repairs the vehicle without Party A’s approval, Party A may require re-repair in accordance with the original factory estimate. (Party A retains the right to determine the maintenance date and designated repair shop in case of vehicle damage.)
Article 8: If the vehicle is damaged but not a total loss (a total loss is defined by the insurance policy as repair costs exceeding 75% of the vehicle’s insured amount after depreciation), Party B’s maximum insurance compensation liability is NT$50,000. If the vehicle is a total loss, Party B shall additionally compensate 25% of the vehicle’s current value. (The current value of the vehicle is calculated as the new car announced price × 0.976n, where n = number of months since the vehicle’s production date. Excluding trucks.)
Article 9: Party B shall fulfill its obligations as a manager to maintain and protect the vehicle. Acts such as selling, encumbering, mortgaging, guaranteeing, or pawning the vehicle are prohibited.
Article 10: The vehicle is insured with Compulsory Vehicle Liability Insurance. If the compensation amount for losses caused by intent or negligence exceeds the insurance coverage (including property damage, mental damage, loss of income, and third-party losses), Party B shall bear the excess, which has no relation to Party A. This contract does not include comprehensive coverage, theft coverage, third-party liability insurance, or other accident insurance; please drive carefully. For acts causing losses to Party A, in addition to full compensation, Party B shall bear 70% of the listed rental fee for maintenance periods of 10 days or less; 60% for 11-15 days; and 50% for more than 16 days.
Article 11: Party B shall return the vehicle to the agreed location (stated on the front of this contract) before pickup. If Party B fails to return the vehicle to the agreed location, Party B agrees to pay a handling fee of NT$3,000 (unless Party A’s prior approval is obtained, in which case fees will be charged as agreed).
Article 12: Party B must obtain Party A’s approval to extend the rental period and pay the extension rent. If Party A disagrees, the vehicle must be returned within the contract period with no objections. Party B agrees that if the vehicle is not returned on time or rent is overdue, Party A may retrieve the vehicle from its parked location and claim fees incurred from retrieving the vehicle. During the period before Party A retrieves the vehicle, rights and obligations shall remain subject to this contract.
Article 13: Before renting, both parties must inspect the vehicle; Party B must immediately report any issues. Party A shall ensure the vehicle is in the agreed condition upon delivery. If mechanical failures occur within 1 hour of pickup or 40km of driving, Party B must immediately notify the company. For failures occurring after more than 1 hour or 40km, Party B shall bear all repair costs. Emergency repairs shall be conducted at Party A’s designated repair shop. If no replacement vehicle is available, Party B may terminate the contract but shall not claim any compensation from Party A. Party B shall be responsible for repairing flat or blown tires.
Article 14: Party B unconditionally agrees that if arrears in rent, repair fees, fines, or other payable/compensation fees remain unpaid after Party A’s demand, the retained items or collaterals shall belong to Party A, who may dispose of them at will. Party B also authorizes Party A to engrave a seal in Party B’s name specifically for the transfer of movable property ownership.
Article 15: Party A has the right to finally interpret and terminate this contract; Party B shall have no objections and shall not make any claims against Party A.
Article 16: Party B or any person authorized by Party B to drive the rented vehicle must hold a valid driver’s license and shall not violate Article 35 of the Road Traffic Management Penalty Act or commit the following acts prohibited by Article 43 of the same Act: 1. Swerving or dangerous driving in any way, including but not limited to drunk driving, drug use, or use of hallucinogens, narcotics, or similar controlled substances; 2. Exceeding the speed limit by more than 40km/h; 3. Forcing other vehicles to give way by approaching, suddenly changing lanes, or other improper means; 4. Suddenly slowing down, stopping, or pausing in the lane without emergency reasons; 5. Removing the muffler or causing noise in other ways; 6. Two or more vehicles jointly committing the acts listed in items 1-5, or racing on the road; 7. Criminal acts or any violations of laws, including but not limited to theft of forest products, receiving, transporting, hiding, buying, or brokering stolen goods as stipulated in Article 50, Paragraph 1 of the Forestry Act; 8. Violating Article 35 of the Road Traffic Management Penalty Act.
Article 17: If Party B/the payer uses a credit card for payment, it signifies authorization to Party A to process the credit card receipt in Party B/the payer’s name for payment, agrees to reserve the total amount of due fees for Party A, and authorizes Party A to collect all fines from Party B/the payer through their credit card company; Party B/the payer shall not refuse.
Article 18: Party A has explained each clause of this contract to Party B before signing, and Party B has carefully reviewed all clauses. Party B is not required to take the contract back for a 7-day review period.
Article 19: If Party B violates Article 35 of the Road Traffic Management Penalty Act and the designated vehicle is impounded in accordance with Article 85-2 of the same Act, Party B agrees to authorize Party A to handle installment payment of fines to retrieve the vehicle.
Article 20: Party A shall guarantee that the vehicle is in the agreed condition during the rental period. If this guarantee is breached, both parties shall act in accordance with laws governing product liability or breach of contract.
Article 21: Unspecified matters or disputes under this contract shall be resolved fairly in accordance with the Ministry of the Interior’s standardized contracts, relevant laws, customs, and the principle of good faith.
Article 22: The vehicle is equipped with a GPS positioning and security system to ensure driving safety; Party B has no objections.
Article 23: The Guarantor (Party C) shall jointly abide by the contract terms with Party B. In case of losses to the company or breach of obligations, Party C shall be jointly and severally liable for compensation.
Article 24: This contract is made in duplicate, with one held by each party. For any litigation arising from this contract, both parties agree that the New Taipei District Court shall have first-instance jurisdiction, but this does not exclude the application of small claims jurisdiction as stipulated in Article 47 of the Consumer Protection Act and Article 436-9 of the Code of Civil Procedure. The actual contract content shall be subject to the paper version at the store.
